DAHIL sa “insufficient in form and content,” ibinasura ng Second Division ng Commission on Elections (Comelec) ang protestang isinampa ng talunang kandidato na si Alexander Lopez laban sa incumbent Manila Mayor Honey Lacuna at dito ay pinagtibay ang landslide na pagkapanalo nang kauna-unahang babaeng alkalde ng Maynila noong May 2022 elections.
Sa pitong pahinang desisyon ng poll body, kaya ibinasura ang protesta ni Lopez ay dahil ito ay “insufficient in form and content”, ibig sabihin ay hindi ito nakapagbigay ng matibay na ebidensya na susuporta sa kanyang alegasyon.
Sinasaad sa desisyon ng Comelec Second Division na “the alleged documented massive acts of vote buying… are bare assertions uncorroborated by any other proof, whether testimonial or documentary”.
Si Lacuna ay nakatanggap ng 538, 595 na boto noong May 9 polls na nagbigay sa kanya ng landslide victory kontra Lopez na nakatanggap lamang ng 166, 908 votes.
Labis na ikinatuwa naman ni Lacuna ang naging desisyon ng Comelec at nagsabing ito na ang magtutuldok sa nasabing protesta.
“While it is Mr. Lopez’ right to file a protest as he sees fit, the reality is that the people of the City of Manila have overwhelmingly expressed and placed their support for the current, duly elected city administration. All the voters in our city deserve to have their collective choice, recognized and given due course for the remainder of the incumbent’s term,” sabi ng lady mayor.
“Furthermore, we are grateful that the Comelec Second Division has also recognized and ruled accordingly, that these allegations of electoral fraud, irregularities, and anomalies remain just that—allegations that have no actual proof. No evidence has been found to support any of these claims,” dagdag pa nito.
Sinabi rin ng alkalde na panahon para sa lahat na may kaugnayan sa nasabing protesta na bumalik na sa kani-kanilang trabaho upang tulungan ang mamamayan ng Lungsod ng Maynila, dahil aniya marami pang suliranin na kinakaharap ang mga ito na labis na nakakaapekto sa kanilang kabuhayan at uri ng pamumuhay.
“I strongly suggest that Mr. Lopez does the same thing in his present capacity”, sabi ni Lacuna.
Matatandaan na naghain ng kanyang election protest si Lopez noong May 23, 2022 pero binasura ito ng Comelec Second Division dahil sa mga sumusunod na dahilan: there were no actual affidavits from voters supporting Lopez’ allegations that their votes were miscounted, disregarded, nor that they actually voted for Lopez but somehow their votes were counted for Lacuna; there were no affidavits from witnesses, whether voters or poll watchers supporting Lopez’ allegations of numerous and widespread electoral fraud, nor for his allegations of instances of vote-buying.
Dagdag pa dito, sa kabila na mayroon ngang pagkakaibang nakita sa pagitan ng mga bilang ng registered voters (886,133) at sa bilang ng actual voters (846,179), nabigo naman si Lopez na patunayan na ito ay dahil sa electoral fraud.
Sa desisyon ng Comelec Second Division ay binigyang diin nito na, kahit pa nga mayroong discrepancy na 31,608 votes na maling nabilang at kahit na idagdag pa ito sa boto ni Lopez ay hindi pa rin ito sapat para mabago ang resulta ng eleksyon.
Inilarawan ng Comelec ang lamang ni Lacuna kay Lopez na ‘massive’ o sobrang napakalaki, kaya naman kahit na ang mga unaccounted/missing ballots ay ikarga kay Lopez, hindi pa rin sasapat ito upang mabago ang resulta ng eleksyon kung saan ang incumbent na si Mayor Lacuna ay nanalo sa eleksyon nang may lamang na 371, 687 votes.
“Undeniably, the protestant (Lopez) employed general and unsubstantiated averments without particularly specifying the circumstances relating to the alleged electoral frauds, anomalies or irregularities,” ayon sa poll body .
Sinabi pa ng Comelec na kung ipagpapatuloy pa ni Lopez ang protesta, magiging sayang lamang ang pagod para sa Comelec at ni Lopez mismo. (ANDI GARCIA)
