Inabsuwelto ng Supreme Court (SC) ang isang dating opisyal ng National Bureau of Investigation (NBI) at kapatid nitong empleyado ng Bureau of Immigration (BI) sa kasong graft and corruption, robbery -extortion at paglabag sa Code of Conduct and Ethical Standard of Public Officials and Employees na idinawit sa kontrobersiyal na “pastillas scam” sa Ninoy Aquino International Airport (NAIA).
Unang inabsuwelto ng Manila Regional Trial Court Branch 18 sina Atty. Joshua Paul Capiral, dating chief of NBI Legal Assistance Office at kanyang kapatid na Immigration Officer (IO) Christopher John Capiral.
Ang kaso laban sa magkapatid ay isinampa ni Jeffrey Dale Ignacio, umano’y miyembro ng kontrobersiyal na “pastillas” group sa BI.
?Bukod sa kasong graft, kinasuhan rin ang magkapatid ng robbery- extortion dahil sa paghingi ng P200,000 sa kanya kapalit ng legal services at pag-dismiss sa kasong kriminal sa Office of the Ombudsman.
?Sa desisyon ng SC na may petsang Enero 3 ,2022, dinismiss ang kasong graft laban sa magkapatid na Capiral dahil sa pagkabigo ng prosecution na makapag-prisinta ng sapat na ebidensiya.
“In the instant case, it was clearly set forth that the case where Ignacio was charged was pending with the Ombudsman, and there was no sufficient evidence to show that Atty. Capiral and IO Capiral, who are employees of the NBI and BI, respectively, had established connections with the Ombudsman, a different government agency, sufficient to influence the cases pending with the said office,” ayon sa korte.
“Hence the Court finds that the prosecution’s evidence fell short in proving all the elements of violating Sec 3 of RA 3019,” dagdag pa ng korte.
Nalaman rin na kinatigan ng RTC Branch 18 ang demurrer to evidence na isinampa ng magkapatid na Capiral,dahil nabigo si Ignacio na maihayag ang pangyayari na maaring maging dahilan para magbigay siya ng pera sa magkapatid na Capiral.
“Ignacio failed to narrate an event that might constitute intimidation, which forced him to give money. Ignacio later admitted that the accused did not ask for money,” the decision said.
Ipinunto rin ng SC na inamin ni Ignacio na hindi sila nagkaroon ng komunikasyon ni Atty.Capiral sa entrapment operation. (JERRY S. TAN)
