HINDI tinulungan si Sonny Trillanes ng kanyang mga kasama sa oposisyon noong inihahanda niya at mga kasama sa Magdalo ang sakdal na crimes against humanity laban kay Rodrigo Duterte at mga kasabwat para isumite sa International Criminal Court (ICC). Pinipigilan siya ng ilang kasapi sa oposisyon dahil ninenerbiyos na madamay sila at mapag-initan ng tila nababaliw na dating alkalde ng Davao City.
Mga huling bahagi ito ng 2016, o unang taon ng pag-upo ni Duterte bilang pangulo. Malakas ang loob ni Duterte na ipatupad ang kanyang bersyon ng digmaan kontra droga dahil sa paniniwala niya na may mandando, o pahintulot, sa kanya ang sambayanan na isagawa ang maramihang patayan sa ilalim ng kanyang digmaan kontra sa droga. Nasa rurok siya ng tagumpay. Walang humpay ang mga patayan, o extrajudicial killings (EJKs), kahit na hindi naayon sa batas. Pinapatay na parang mga manok ang sinuman na pinaghihinalaan na sangkot sa droga.
Pinipigilan siya ng mga kasama sa oposisyon dahil sa kanilang tingin ay walang mangyayari sa sakdal. Dumistansya sa kanya ang mga kasama. Kinakantiyawan siya ng mga kapanalig ni Duterte. “Mapupunta sa basurahan ng kasaysayan ang sakdal na iyan,” ani Ping Lacson. “Suntok iyan sa buwan,” ani JV Ejercito na natalo nang tumakbo bilang reeleksiyonista noong nakaraang taon. Wala kakampi si Sonny Trillanes sa Senado maliban kay Leila de Lima na ipinakulong ni Duterte sa mga gawa-gawang bintang.
Natakot kahit si Bise Presidente Leni Robredo sa habla na naisip ng Magdalo sa pangunguna ni Sonny Trillanes. Kinabagan at kinabahan si Leni dahil ginamit ni Duterte ang puwersa ng PNP upang ipatupad ang kanyang madugo ngunit nabigo digmaan kontra droga. Hindi kailanman humingi si Leni ng briefing, o paliwanag, tungkol sa kasong iniharap laban kay Duterte. Hindi niya kinausap si Trillanes tungkol sa sakdal. Nagkaroon sila ng kontak bago ang halalan ng 2019 dahil kabilang si Gary Alejano sa tiket ng Otso Diretso.
Hindi pinanghinaan ng loob si Sonny Trillanes; hindi siya natinag sa mga pagpigil ng mga kasama. Naunang isinumite ng namayapang manananggol na si Jude Sabio ang sakdal noong Abril, 2017. Nang panghinaan ng loob si Sabio dahil sa sobrang pangangailangan ng salapi, itinuloy niTrillanes at Alejano ang sakdal sa ICC. Proyekto ito ng Magdalo mula umpisa at hindi nila bitiwan kahit may mga salita na nakakapagpahina ng loob. Walang ibang nakaisip nito kundi ang grupo ni Trillanes.
Isinumite ni Trillanes at Alejano ang sakdal sa ICC dahil hindi tama ang mga patayan, o EJKs, bilang solusyon sa problema. May batas na dapat ipatupad at hukuman kung saan dapat dalhin ang mga may sala. Ito ang kinapitan ni Sonny Trillanes na paniniwala kahit halos nag-iisa siya sa pagtayo laban sa digmaan kontra droga ni Duterte. Naniniwala siya sa pangibabaw ng batas (rule of law) at tamang proseso.

PROF. SONNY Trillanes encountered enormous trials and tribulations, and endured slings and arrows when he was planning and working on a major initiative against Rodrigo Duterte – the filing of crimes of humanity charges against him and fellow conspirators before the International Criminal Court (ICC). Political figures allied with Duterte mocked him no end, saying nothing positive would come out of it. Even fellow opposition leaders were not hopeful of his initative and distanced from him. Only Gary Alejano, a fellow Magdalo lawmaker, joined him and signed the information against Duterte et. Al.
It was understandable to encounter those negative things. It was 2017 and Duterte was at the height of his power. His bloody but failed anti-drug war was at full swing. Nobody could stop Duterte and his minions from killing those hapless citizens on the basis of suspicion of their drug use and pushing. Trillanes, who was then a senator, serving the last three years of his second term, could only watch helpless at the impunity of those extrajudicial killings (EJKs). There was no rule of law and the human rights violations had reached alarming levels.
Appalled and disgusted by the injustice of the EJKs, Sonny Trillanes, upon consultations with some lawyer-friends, could have thought of a single legal way to stop the EJKs – file charges of crimes against humanity against Duterte et. al. before the ICC. But it was long shot. He could not get support from his own fellow opposition leaders. But clear sighted and determined to pursue what he thought was the best thing to do those days, Sonny Trillanes went against the flow of those days. He and Gary Alejano led in filing the charges against Duterte. It was a lonely battle, but he persisted.
He did not know that what he and Alejano had started in 2017 would prosper and go a long way. Now, Duterte is on the defensive. He does not know what to do. The system and people at ICC are so different from what we have in the Philippines. It is a gray area for him and he has no control. It’s fun to watch a madman getting haywire on the things he has no control. He has to rely on Herminio Roque, who is an alleged but overrated expert on international law.

RODRIGO Duterte can run for VP in 2022 and he may win. What if the winning president won’t belong to his ticket? He may not know what will happen next. Duterte and several other guys like Dick Gordon, Alan Peter Cayetano, Bato dela Rosa, Jose Calida, Vitaliano Gorospe, and others face crimes against humanity charges before the ICC. He can have a fate similar to Slobodan Misolovic, the former president of Serbia, who underwent trial at the International Criminal Tribunal on the former Yugoslavia (ICTY), a forerunner of the International Criminal Court (ICC). Nobody thought he would undergo the ICTY trials.
Milosevic was at the height of his power when charges of crimes against humanity, genocide, and war crimes were filed against Milosevic. But when he was out of power, it was a totally different story. His successor encouraged his arrest after he was promised that developed countries would provide $1 billion in ODA to Serbia and other parts of Yugoslavia that were ravaged by the Balkan War. Moreover, his successor was promised Serbia’s membership in the European Union. His successor jumped at the opportunity and sacrificed Milosevic, who was viewed as the “Butcher of the Balkan.”
No leader would want to be identified with Milosevic, who had a dirty record on human rights. The butcher of Yugoslavia underwent a three-year trial and it only stopped after he suffered a heart attack and died while in prison. He did not have freedom and was never vindicated. Duterte does not enjoy a positive reputation in the international community. He is being viewed as a deranged, blood-thirty murderer. Many things could happen.
